ConsultRX Privacy Policy
OVERVIEW
Your access to the ConsultRX LLC (“ConsultRX LLC”) mobile application and websites, and the co-branded ConsultRX-affiliate websites, collectively, the (“ConsultRX Digital Services”), is subject to the ConsultRX Terms of Use and this Privacy Policy. By agreeing to our terms and privacy policy you also agree to the terms and privacy policy of our website management partner, DrugStore2Door (DS2D), whose privacy policy can be found here. This Privacy Policy applies only to information collected through the ConsultRX LLC Digital Services and not to information collected offline.
Your privacy is important to ConsultRX LLC. This Privacy Policy explains what information we gather from you when you use our services, how we may use that information, the security approaches we take to protect your personal information, and how you can access and update certain information that we collect. This Privacy Policy is incorporated and made part of the ConsultRX LLC Terms of Use.
ACCEPTANCE OF PRIVACY POLICY
By using the ConsultRX LLC Digital Services, you consent to the collection and use of your information by ConsultRX LLC in accordance with this Privacy Policy. If you do not agree to this Privacy Policy, you may not use the ConsultRX LLC Digital Services.
You understand that if you’re using the ConsultRX LLC Digital Services from a country outside the United States, you will be transferring personal information about yourself to the United States. You understand that the privacy laws of the United States may not be as comprehensive as those in your country, and you agree that the transfer of your personal information occurs with your consent. Personal information collected by the ConsultRX LLC Digital Services may be stored and processed in the United States or abroad.
MODIFICATION OF PRIVACY POLICY
ConsultRX LLC reserves the right to change this Privacy Policy at any time and without prior notice. Changes take effect on the date that appears on the revised Policy. If you use the ConsultRX LLC Digital Services following a change in the Policy, your use represents your acceptance of the changes. You are responsible for frequently reviewing this Privacy Policy for changes.
WHAT INFORMATION WE COLLECT
You will be asked to provide personal information when you register your ConsultRX LLC Digital Services account, place an order, respond to communications such as e-mail, or make use of another ConsultRX LLC Digital Services feature. We may ask you for your name, e-mail address, mailing address, phone number, credit card information, or other information. ConsultRX LLC uses this information consistent with this Privacy Policy, and we may also combine it with other information to provide and improve our services, content, and advertising. You are not required to provide the personal information that we have requested, but if you choose not to do so, we may not be able to provide you with certain services or respond to certain inquiries you may have. You may, however, use portions of the ConsultRX LLC Digital Services without providing such information.
We use IP addresses and session identifiers to analyze trends, to administer ConsultRX LLC Digital Services, to track user activities, to infer user interests, and to otherwise induce, deduce, and gather information about individual users and market segments. We use cookies and local storage to enhance your experience and gather information about visitors and visits. Please refer to the “Cookies” section below for information about these mechanisms and how we use them.
When signing up for pharmacy services or ordering prescription drugs, we may ask you to provide us with certain personal and/or health-related information. This information is subject to our HIPAA Privacy Notice, which more specifically describes how we may use or disclose your protected health information.
We may collect personal data from you from third parties. We may use analytics service providers to analyze how you interact and engage with the ConsultRX LLC Digital Services, or third parties may help us provide you with customer support. When you sign up for an account with us using your calendar provider, such as Google Calendar or Office 365, we may import the contents of your calendar account, including any calendars to which you have access, to your ConsultRX LLC Digital Services account. Additionally, if you register an account that is part of an organization, we may collect the names and email addresses affiliated with your organization.
HOW WE USE YOUR INFORMATION
We may use the information we collect from you when you register, post or purchase products, respond to a survey or marketing communication, or use other ConsultRX LLC Digital Services features in the following ways:
- To personalize your experience and to allow us to create, develop, operate, improve, and deliver the type of content and product offerings in which you are most interested.
- To allow us to better service you in responding to your customer service requests.
- To quickly process your transactions.
- To verify and validate your identity.
- To troubleshoot problems with ConsultRX LLC’s Digital Services, as requested.
- To enforce the Terms of Use, and to detect and protect against loss, error, fraud and other unauthorized or illegal activities.
- To provide any legitimate business service or product.
- To send important notices, such as communications about transactions and changes to our Terms of Use, Privacy Policy, and HIPAA Privacy Notice. Because this information is important to your use of the ConsultRX LLC Digital Services, you may not opt out of receiving these communications.
- For internal purposes such as auditing, data analysis, and research to improve our services and customer communications.
We may disclose your personal and other information to third parties, as follows:
- To vendors whose products or services you have requested, in order to deliver those products or services to you.
- To our subsidiaries or affiliates, strategic partners and to third parties we engage to provide services on our behalf, such as website hosting, credit card payment processing, order processing, delivery, etc. We prohibit these parties from using your personal information for any other purpose.
- To vendors that offer products, services or other information we think might interest you. These third parties may keep and use your personal information whether or not you purchase their products or services. Your personal information will be subject to their privacy policies, so you should contact them directly for information on their policies or to opt-out of promotional communications from them.
- In the event of the sale or transfer of ConsultRX LLC, of one or more of our business units or of some or all of our assets, or in the context of some other business acquisition transaction.
- In response to a subpoena or court order, or a request from a law enforcement or other government agency; to establish or exercise our legal rights, or to defend against claims; or to protect the safety or security of the public or of users of the ConsultRX LLC Digital Services.
- We may forward your prescription information to your insurance plan, so that we may handle reimbursement of your prescription purchase for your convenience.
- We can disclose aggregate information about users of the ConsultRX LLC Digital Services to our service providers, partners, advertisers or others, but such information will not include personal information.
COOKIES, ETC.
Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. Cookies help us make your use of the ConsultRX LLC Digital Services easier and more effective, such as by understanding usage patterns to improve the functionality of the mobile application or website. For instance, we use cookies to help us understand your preferences based on previous or current website activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about website traffic and interaction so that we can offer better experiences and tools in the future.
We may contract with third-party service providers to assist us in better understanding the ConsultRX LLC Digital Services visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. If you turn cookies off, you won’t have access to many features that make your online experience more efficient and some of our services may not function properly.
In addition to cookies, ConsultRX LLC may use browser local storage technology to store your preferences and make your user experience more consistent. Local storage is a persistent type of storage that provides functionality similar to cookies, but unlike cookies, its contents are not transmitted across the Internet. You can control how local storage works through your browser settings as well. Disabling the local storage functionality on your browser may result in loss of functionality in the ConsultRX LLC mobile application and website.
We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.
ConsultRX LLC and its partners may use cookies and other technologies to remember personal information when you use our website, online services, and mobile application. Our goal in these cases is to make your experience more convenient and personal. For example, knowing your first name lets us welcome you the next time you access the ConsultRX LLC Digital Services. Knowing your country and language helps us provide a customized and more useful experience, and provide you with better customer service.
As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data. - We may say “no” to your request, but we’ll tell you why in writing within 60 days.
Request confidential communications
- You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.
- We will say “yes” to all reasonable requests.
Ask us to limit what we use or share
- You can ask us not to use or share certain health information for treatment, payment, or our operations.
Get a list of those with whom we’ve shared information
- You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why.
- We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly.
Choose someone to act for you
- If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
- We will make sure the person has this authority and can act for you before we take any action.
File a complaint if you feel your rights are violated

- Share information with your family, close friends, or others involved in your care

- Include your information in a hospital directory
If you are not able to tell us your preference, for example if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.
In these cases we never share your information unless you give us written permission:

- Sale of your information
- Most sharing of psychotherapy notes
In the case of fundraising:
- We may contact you for fundraising efforts, but you can tell us not to contact you again.

How do we typically use or share your health information?
We typically use or share your health information in the following ways.
Treat you
We can use your health information and share it with other professionals who are treating you.
Example: A doctor treating you for an injury asks another doctor about your overall health condition.
Run our organization
We can use and share your health information to run our practice, improve your care, and contact you when necessary.
Example: We use health information about you to manage your treatment and services.
Bill for your services
We can use and share your health information to bill and get payment from you.
How else can we use or share your health information?
We are allowed or required to share your information in other ways – usually in ways that contribute to the public good, such as public health and research. We have to meet many conditions in the law before we can share your information for these purposes. Your personal identifiable information such as name and address will never be disclosed under such purposes, but general information unidentifiable to a single person may be used.
